Mangomint Additional Product Terms
Last Updated: July 2, 2026These Mangomint Additional Product Terms (“Additional Product Terms”) supplement and are incorporated by reference into the Mangomint Terms of Service (the “Agreement”) between Mangomint, Inc. (“Mangomint,” “we,” “us,” or “our”) and you (“you” or “your”) and govern your use of Services features governed by these Additional Product Terms, whether as an Account Owner, User, or otherwise. Capitalized terms used but not defined in these Additional Product Terms have the meanings given to them in the Agreement.
By enabling, accessing, or using any Services feature governed by these Additional Product Terms, you acknowledge that you have read, understood, and agree to be bound by the applicable provisions of these Additional Product Terms.
- Mangomint Connect
- Overview. Mangomint Connect (“Connect”) is an optional communications add-on feature that enables Account Owners and their Users to place and receive voice calls, send and receive SMS and MMS messages, and engage in real-time chat with Clients, all through the Mangomint Platform (collectively, the “Connect Services”). Connect relies on telecommunications infrastructure and services provided by Twilio Inc. (“Twilio”). Mangomint does not act as a telecommunications carrier, and all telephony and messaging services delivered through Connect are provided through Twilio’s platform. Mangomint makes no representations regarding the regulatory classification of Connect under federal or state telecommunications laws. The Connect Services may include certain call analysis features, including transcription, summarization, sentiment analysis, or related analytics, that may be provided using third-party artificial intelligence, speech-to-text, or analytics providers.
- Subscription Required. Access to Connect requires a separate subscription or add-on as described in your Order or the applicable pricing page. All fees for Connect are subject to the billing and payment terms set forth in Section 6 of the Agreement and these Additional Product Terms.
- Compliance with Twilio Policies. You acknowledge that Connect is powered by Twilio and that your use of Connect is subject to Twilio’s Acceptable Use Policy (available at https://www.twilio.com/legal/aup) and any service- and country-specific requirements set forth therein, as each may be updated from time to time. You shall not, and shall not permit any User or Client to, use Connect in any manner that violates Twilio’s Acceptable Use Policy. You acknowledge that Twilio may suspend or terminate the underlying telephony and messaging services if your usage violates Twilio’s policies, and that Mangomint shall have no liability for any resulting disruption to Connect. Twilio may update its Acceptable Use Policy and other terms from time to time. Your continued use of Connect following such update constitutes your acceptance of the updated terms.
- Communications Law Compliance. You shall comply with all Communication Laws (as defined in the Agreement) in connection with your use of Connect, including without limitation the U.S. Telephone Consumer Protection Act (“TCPA”), the U.S. CAN-SPAM Act, federal and state wiretapping and electronic surveillance statutes (including the federal Wiretap Act, 18 U.S.C. sections 2510-2522), Canadian Anti-Spam Legislation, state laws requiring disclosure of artificial intelligence or automated systems in communications, and all applicable industry and carrier regulations and best practices, including the CTIA’s Messaging Principles and Best Practices.
- Consent Requirements. You are solely responsible for obtaining all consents required under the Communication Laws and other Applicable Laws before initiating voice calls, sending text messages, or enabling AI-assisted call analysis features or communications with Clients through Connect, including: (a) prior express written consent for marketing messages subject to the TCPA; (b) prior express consent for informational or transactional messages; and (c) consent from all parties to a call before recording, monitoring, or permitting AI-based analysis of any voice call, as required under applicable federal and state wiretapping and eavesdropping statutes (including in two-party or all-party consent jurisdictions).
- Content Responsibility. You are solely responsible for the content of all messages, calls, and other communications sent or received through Connect, including ensuring that such content does not violate any Applicable Laws, Communication Laws, or the Twilio Acceptable Use Policy.
- Prohibited Communications. Without limiting the terms of the Agreement or these Additional Product Terms, you shall not use Connect to: (a) send unsolicited commercial messages or make unsolicited telemarketing calls in violation of the TCPA or other Communication Laws; (b) transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (c) engage in telephony denial-of-service attacks or other activities that disrupt telecommunications networks; or (d) spoof caller ID information in violation of the Truth in Caller ID Act or analogous state laws.
- Call Recording and Monitoring. If you use Connect in a manner that records, transcribes, monitors, or permits AI-based analysis of a voice call, you represent and warrant that: (a) you will obtain the caller’s consent where required by Applicable Laws and Communications Laws (including in two-party or all-party consent jurisdictions); and (b) you will comply with any additional disclosure requirements imposed by Communication Laws or other Applicable Laws.
- Connect Data as Account Data. All data processed through Connect, including call recordings, voicemails, call transcripts, call summaries, sentiment analysis or related analytics and other outputs generated from call content, call metadata (such as caller ID, call duration, and timestamps), SMS and MMS message content, and chat logs, constitutes Account Data as defined in the Agreement and is subject to the data ownership, licensing, and processing provisions of Section 5 of the Agreement.
- HIPAA. You shall not use the Connect Service to collect, transmit, or process PHI unless you have (i) registered and paid to Mangomint the applicable fees for a HIPAA-Enabled Subscription Plan, and (ii) executed Mangomint’s Business Associate Agreement (“BAA”). You are solely responsible for providing any notices, and obtaining any consents, that may be necessary under HIPAA to collect, transmit, or process PHI through the Connect Service.
- Data Sharing with Twilio. By subscribing to Connect, you authorize Mangomint to disclose your Account Data to Twilio as necessary to provide the Connect Services. You represent and warrant that you have given such notices to, and obtained such consents from, your Users and Clients as may be necessary under Applicable Laws for Mangomint to disclose your Account Data to Twilio and for Twilio to process such Account Data.
- Regulatory Fines and Penalties Pass-Through. You will pay all costs, fines, or penalties that are imposed on Mangomint by a government or regulatory body or a telecommunications provider as a result of your or your Users’ or Clients’ use of Connect.
- Usage Limits. Mangomint reserves the right to impose usage limits or suspend Connect access if your usage materially exceeds expected patterns, indicating potential misuse or account compromise, or if continued usage would result in material costs to Mangomint.
- Telecommunications Disclaimers. WITHOUT LIMITING SECTION 9 OF THE AGREEMENT, MANGOMINT EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES REGARDING THE AVAILABILITY, RELIABILITY, TIMELINESS, OR QUALITY OF VOICE CALLS, TEXT MESSAGES, OR OTHER COMMUNICATIONS TRANSMITTED THROUGH CONNECT. MANGOMINT DOES NOT GUARANTEE DELIVERY OF MESSAGES OR CONNECTION OF CALLS, AS SUCH TRANSMISSION DEPENDS ON THIRD-PARTY CARRIERS, NETWORK CONDITIONS, AND THE RECIPIENT’S DEVICE. YOU ACKNOWLEDGE THAT THE INTERNET AND TELECOMMUNICATIONS PROVIDERS’ NETWORKS ARE INHERENTLY INSECURE AND THAT MANGOMINT WILL HAVE NO LIABILITY FOR ANY CHANGES TO, INTERCEPTION OF, OR LOSS OF DATA WHILE IN TRANSIT VIA THE INTERNET OR A TELECOMMUNICATIONS PROVIDER’S NETWORK. THE FOREGOING DISCLAIMERS ARE MADE ON BEHALF OF BOTH MANGOMINT AND THE MANGOMINT PARTIES.
- Emergency Services. Connect does not support emergency calling to emergency services. You agree not to enable or attempt to use outbound voice functionalities of Connect to contact official, government-sponsored emergency telephone numbers (such as but not limited to 911 or 112) which are used to dispatch professional emergency responders for emergency services (“Emergency Services”). You are required to notify Users prominently and clearly that access to Emergency Services are not available on Connect. You represent and warrant that you have arranged for and provide other methods for communicating with Emergency Services to be available at all times to any Users of Connect. NEITHER MANGOMINT NOR ITS REPRESENTATIVES WILL BE LIABLE FOR ANY CLAIM (INCLUDING THIRD-PARTY CLAIMS), DAMAGE, OR LOSS (AND YOU WILL INDEMNIFY, DEFEND AND HOLD MANGOMINT HARMLESS AGAINST ANY AND ALL SUCH CLAIMS) ARISING FROM OR RELATING TO THE INABILITY TO USE CONNECT TO CONTACT EMERGENCY SERVICES.
- Suspension of Connect. Mangomint may suspend your access to Connect, in whole or in part, without suspending your access to other Services, if: (a) your use of Connect violates these Additional Product Terms, the Agreement, any Communication Law, or Twilio’s Acceptable Use Policy; (b) Twilio suspends or terminates the underlying telephony or messaging services for any reason; (c) continued operation of Connect for your Account poses a risk to Mangomint, other customers, or third parties; or (d) Mangomint determines, in its reasonable judgment, that suspension is necessary to comply with a legal or regulatory requirement.
- Changes to Connect Services. You acknowledge that Connect’s functionality may change from time to time due to changes by Twilio or other telecommunications providers. Mangomint will use commercially reasonable efforts to provide notice of material changes but cannot guarantee feature continuity. Mangomint shall have no liability for changes to Connect resulting from changes to Twilio’s services or policies.
- Mira AI Agent
- Overview. Mira is Mangomint’s AI-powered virtual agent feature that uses artificial intelligence to handle inbound voice calls, provide AI-assisted text messaging (SMS/MMS) responses, and facilitate AI-powered web chat on behalf of the Account Owner’s business (collectively, the “Mira Service”). The Mira Service is designed to assist with appointment scheduling, client inquiries, and routine business communications. Mira operates within the Mangomint Platform and utilizes the telephony and messaging infrastructure provided through Connect.
- AI Technology. The Mira Service is powered by third-party artificial intelligence models and APIs, including those provided by OpenAI, L.L.C. (“OpenAI”) and Anthropic, PBC (“Anthropic”) (collectively, the “AI Providers”). Mangomint may change, add, or replace AI Providers at any time without prior notice. The Mira Service generates responses, summaries, and other outputs using machine learning and large language models, and such outputs are AI-generated content, not human-authored content. You acknowledge that, in order to provide the Mira Service, Mangomint transmits certain Account Data (including the content of calls, messages, and chats processed by Mira) to the AI Providers for the purpose of generating AI outputs, and you agree that each AI Provider may use Account Data and other inputs to deliver outputs, comply with Applicable Laws, and enforce its respective policies.
- No Guarantee of Accuracy. You acknowledge and agree that (a) the Mira Service may produce responses that are inaccurate, incomplete, or inappropriate; (b) AI-generated outputs may not reflect your business’s policies, preferences, or factual circumstances; and (c) you are solely responsible for reviewing, supervising, and correcting Mira’s outputs and for any actions taken or decisions made in reliance on such outputs. Factual assertions in AI-generated outputs should not be relied upon without independently checking their accuracy, as they may be false, incomplete, misleading, or not reflective of recent events or information. You acknowledge this limitation and must notify your Users of the same.
- Eligibility. The Mira Service is available only to Account Owners who maintain an active subscription to Connect. If your Connect subscription is terminated, suspended, or downgraded to a plan that does not include Connect, your access to the Mira Service will automatically terminate. Access to the Mira Service requires a separate subscription or add-on as described in your Order or the applicable pricing page. All fees for the Mira Service are subject to the billing and payment terms set forth in Section 6 of the Agreement.
- Authorized Purposes. You may use the Mira Service solely for lawful internal business purposes in connection with the operation of your business, including responding to Client inquiries, scheduling and managing appointments, providing business information to Clients, and sending follow-up or confirmation messages.
- Configuration and Supervision. You are responsible for configuring the Mira Service appropriately for your business, including setting business hours, service menus, policies, and any guardrails or instructions available within the Mira configuration tools. You acknowledge that you remain responsible for supervising the Mira Service’s interactions with Clients and for promptly correcting any errors or misrepresentations.
- General Prohibitions. In addition to the restrictions set forth in the Agreement, you shall not, and shall not permit any User to, use the Mira Service to: (a) generate, transmit, or facilitate the transmission of content that is unlawful, harmful, threatening, abusive, harassing, defamatory, deceptive, or fraudulent; (b) impersonate any person or entity or misrepresent Mira’s outputs as having been authored or reviewed by a human when required by law to disclose AI involvement; (c) provide medical, legal, financial, or other regulated professional advice to Clients; (d) collect sensitive personal information (including Social Security numbers, financial account numbers, or health information) through Mira interactions, except as expressly permitted under a HIPAA-Enabled Subscription Plan with an executed BAA; (e) circumvent, disable, or interfere with any safety, filtering, or content moderation mechanisms within the Mira Service; (f) attempt to extract, reverse-engineer, or derive the underlying models, algorithms, weights, or training data of the AI Providers; (g) use the Mira Service for any high-risk or fully automated decision-making that produces legal or similarly significant effects on individuals without human oversight; (h) use output from the Mira Service to develop artificial intelligence models that compete with the products and services of Mangomint or the AI Providers; or (i) use the Mira Service in violation of any AI Provider’s acceptable use policies, as updated from time to time.
- AI Provider Restrictions. You acknowledge that the AI Providers impose restrictions on the use of their models and APIs. Without limiting the foregoing, you agree not to use the Mira Service in any manner that would violate OpenAI’s Usage Policies (available at https://openai.com/policies/usage-policies) or Anthropic’s Usage Policy (available at https://www.anthropic.com/aup), as each may be updated from time to time. Mangomint may suspend or terminate your access to the Mira Service if any AI Provider determines that your usage violates its policies.
- Account Data. All data processed through the Mira Service, including call recordings, call transcripts, AI-generated text responses, chat logs, and associated metadata, constitutes Account Data as defined in the Agreement and is subject to the data ownership and licensing provisions of Section 5 of the Agreement.
- Consent and Disclosure Obligations. You are solely responsible for: (a) informing Clients that they may be interacting with an AI agent rather than a human, in compliance with all Applicable Laws requiring such disclosure; (b) providing all notices and obtaining all consents required under Applicable Laws before permitting the Mira Service to record, transcribe, monitor, or analyze any voice call, including compliance with all federal and state wiretapping and eavesdropping statutes; (c) providing all notices and obtaining all consents required under the TCPA and analogous state laws for AI-assisted or automated text messages sent through the Mira Service; and (d) making appropriate disclosures in your privacy notice regarding the use of AI-powered services and the sharing of Client data with AI Providers. Without limiting the generality of the foregoing, you acknowledge that Mira’s voice-call functionality requires real-time transcription and AI processing of call content in order to operate. Disabling any audio-recording feature does not disable Mira’s real-time transcription, monitoring, or AI processing of call content. You shall not enable or use Mira for voice calls unless you have provided all notices and obtained all consents required under Applicable Laws, including Communication Laws, for such transcription, monitoring, and AI processing.
- HIPAA. You shall not use the Mira Service to collect, transmit, or process PHI unless you have (i) registered and paid to Mangomint the applicable fees for a HIPAA-Enabled Subscription Plan, and (ii) executed Mangomint’s BAA. You are solely responsible for providing any notices, and obtaining any consents, that may be necessary under HIPAA to collect, transmit, or process PHI through the Mira Service.
- AI Outputs. As between you and Mangomint, you shall be the sole and exclusive owner of all outputs generated through your use of the Mira Service (“AI Outputs”) and Mangomint assigns to you all right, title, and interest in such AI Outputs, provided that Mangomint retains the right to use Aggregated Data derived from such AI Outputs as set forth in Section 5 of the Agreement. You acknowledge and agree that: (a) all AI Outputs are provided “as-is”, without any representations or warranties of any kind from Mangomint or the AI Providers (whether oral, written, express, or implied); (b) the AI Outputs may not be complete, accurate, up-to-date, or error-free, and that you are solely responsible for independently verifying the accuracy, currency, and completeness of all AI Outputs; (c) you are solely responsible for any use of the AI Outputs by you or on your behalf, and for any actions taken (or not taken) as a result of your receipt or use of the AI Outputs.
- AI Limitations. THE MIRA SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WITHOUT LIMITING THE GENERALITY OF SECTION 9 OF THE AGREEMENT, MANGOMINT EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE MIRA SERVICE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, CORRECTNESS, TIMELINESS, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY AI OUTPUTS.
- No Professional Advice. THE MIRA SERVICE DOES NOT PROVIDE AND IS NOT A SUBSTITUTE FOR LEGAL, MEDICAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT AI OUTPUTS ARE APPROPRIATE AND LAWFUL BEFORE THEY ARE COMMUNICATED TO CLIENTS, USERS, OR OTHER THIRD PARTIES.
- AI Provider Availability. MANGOMINT DOES NOT WARRANT THAT THE MIRA SERVICE WILL BE AVAILABLE AT ALL TIMES OR THAT AI-GENERATED RESPONSES WILL BE PRODUCED WITHIN ANY SPECIFIED TIMEFRAME. THE MIRA SERVICE DEPENDS ON THIRD-PARTY AI PROVIDERS WHOSE SERVICES MAY EXPERIENCE OUTAGES, RATE LIMITS, OR DEGRADED PERFORMANCE OUTSIDE MANGOMINT’S CONTROL.
- Exclusion of Damages. WITHOUT LIMITING SECTION 10 OF THE AGREEMENT, IN NO EVENT SHALL MANGOMINT OR THE MANGOMINT PARTIES BE LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO: (A) ANY INACCURACY, ERROR, OR OMISSION IN ANY AI OUTPUT; (B) ANY DECISION MADE OR ACTION TAKEN BY YOU, YOUR USERS, OR YOUR CLIENTS IN RELIANCE ON AI OUTPUTS; (C) ANY FAILURE OF THE MIRA SERVICE TO CORRECTLY SCHEDULE, RESCHEDULE, OR CANCEL AN APPOINTMENT; (D) ANY LOSS OF CLIENTS, BUSINESS, OR REVENUE RESULTING FROM MIRA’S INTERACTIONS WITH YOUR CLIENTS; OR (E) ANY CLAIMS BY THIRD PARTIES (INCLUDING YOUR CLIENTS) ARISING FROM MIRA’S COMMUNICATIONS.
- Suspension and Termination of Mira. Mangomint may suspend your access to the Mira Service, in whole or in part, without suspending your access to other Services (including Connect), if: (a) your use of the Mira Service violates these Additional Product Terms, the Agreement, or any Applicable Law; (b) any AI Provider suspends, restricts, or terminates Mangomint’s access to its APIs or models in a manner that affects the Mira Service; (c) continued operation of the Mira Service for your Account poses a risk to Mangomint, other customers, or third parties; or (d) Mangomint determines, in its reasonable judgment, that suspension is necessary to comply with a legal obligation or regulatory requirement.
- AI Provider Terms.
- OpenAI Terms. Your use of the Mira Service is subject to OpenAI’s Usage Policies as they may be updated from time to time. Without limiting the foregoing, you acknowledge and agree that: (a) you will not attempt to use the Mira Service to generate content that violates OpenAI’s Usage Policies; (b) OpenAI’s terms prohibit certain uses of its models, including generating content that could cause harm to individuals, facilitating illegal activities, or creating deceptive content designed to mislead recipients about its AI-generated nature (where disclosure is required); and (c) Mangomint may be required to disable or modify Mira features to comply with changes to OpenAI’s terms.
- Anthropic Terms. Your use of the Mira Service is subject to Anthropic’s Usage Policy as it may be updated from time to time. Without limiting the foregoing, you acknowledge and agree that: (a) you will not attempt to use the Mira Service in any manner prohibited by Anthropic’s Usage Policy; (b) Anthropic prohibits use of its models for certain categories of harm, including generating deceptive, fraudulent, or manipulative content; and (c) Mangomint may be required to disable or modify Mira features to comply with changes to Anthropic’s terms.
- Changes to AI Provider Terms. AI Provider terms and policies may change from time to time. Your continued use of the Mira Service following any such change constitutes your acceptance of the updated AI Provider terms as applied to the Mira Service. If you do not agree to updated AI Provider terms, your sole remedy is to cancel the Mira Service.
- Payroll Processing Services
- Overview. Mangomint may offer Account Owners the option to use certain payroll processing services provided by and through our third-party partner, Salsa Software Inc. (“Salsa”) (such services, the “Payroll Processing Services”). The Payroll Processing Services are Third-Party Services as defined in Section 7 of the Agreement.
- Salsa Terms of Use. If you access or use the Payroll Processing Services through the Services, you as the Account Owner hereby enter into and agree to be bound by the Salsa Payroll Service User Terms of Use as set forth at https://www.salsa.dev/payroll-service-user-terms, as they may be updated from time to time.
- Data Sharing Authorization. By accessing or using the Payroll Processing Services, you authorize Mangomint to disclose your Account Data to Salsa as necessary for Salsa to provide the Payroll Processing Services. You represent and warrant that you have given such notices to, and obtained such consents from, your Users as may be necessary under Applicable Laws for Mangomint to disclose your Account Data to Salsa and for Salsa to process such Account Data to provide the Payroll Processing Services.
- Salsa Data Use. You agree that Salsa may use, modify, and disclose your Account Data (i) to provide the Payroll Processing Services; (ii) to test and improve Salsa’s products and services, including to train Salsa’s algorithms, and for Salsa’s troubleshooting, development, diagnostic, security, and corrective purposes; and (iii) as otherwise set forth in the Salsa Payroll Service User Terms of Use, Salsa’s General Terms of Use as set forth at https://www.salsa.dev/terms-of-use, and Salsa’s Privacy Policy as set forth at https://www.salsa.dev/privacy-policy, as they may be modified from time to time.
- Compliance Responsibility. It is your sole responsibility to comply with all Applicable Laws, including federal, state, and local wage and hour laws, in connection with the Payroll Processing Services. You are responsible for determining whether the Payroll Processing Services meet your business’ payroll and reporting obligations, and we are not providing any legal, financial, accounting, tax or other professional advice to you by providing the Payroll Processing Services. You should consult federal and local government websites and/or consult with qualified counsel to help you with your compliance obligations.
- Generally Applicable Terms
- Indemnification. In addition to and without limiting your indemnification obligations under Section 8 of the Agreement, you agree to defend, hold harmless, and indemnify the Mangomint Parties from and against any claims, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your or your Users’ or Clients’ use of Connect, the Mira Service, or the Payroll Processing Services; (b) any AI Output communicated to a Client or third party through the Mira Service; (c) your failure to provide required disclosures or obtain required consents in connection with voice calls, text messages, AI-assisted communications, or call recording through Connect or the Mira Service; (d) any claim that your use of Connect or the Mira Service violates any Communication Law, Privacy Law, or other Applicable Law, including without limitation claims under the TCPA, state wiretapping statutes, or state biometric privacy laws; (e) any claim by an AI Provider arising from your breach of such AI Provider’s policies; (f) any costs, fines, or penalties imposed by Twilio, a telecommunications provider, or a government or regulatory body as a result of your or your Users’ or Clients’ use of Connect; and (g) your actual or alleged breach of these Additional Product Terms.
- Survival. These Additional Product Terms (to the extent applicable to obligations that by their nature should survive) shall survive any termination or expiration of these Additional Product Terms, the applicable Services feature, or the Agreement.
- Order of Precedence. In the event of a conflict between these Additional Product Terms and the Agreement, these Additional Product Terms will govern with respect to the applicable Services feature.
